Article 1 : Definitions.
Subscriber
The legal or natural person who by means of a subscription agreement has a subscription to the digital editions of Amigoe Aruba, and to whom Quantum Quorum Media N.V. has the obligation, for a certain period of time, at a pre-agreed price, to provide access to the digital edition(s) in question. The Subscriber undertakes to pay the pre-agreed price in advance.
Subscription
The subscription is an agreement between the Subscriber and Quantum Quorum Media N.V., whereby Quantum Quorum Media N.V. undertakes to make available the digital editions of Amigoe Aruba desired by the Subscriber through an online platform, and whereby the Subscriber undertakes to pay the subscription fees set by Quantum Quorum Media N.V., in accordance with provisions in article 5.1.
Subscriptions can be taken out for a definite or indefinite period. Access to digital editions is granted via personal login details, which are non-transferable. At the end of the agreed subscription period, subject to temporary written notice, the subscription is tacitly renewed each time for the same period until rescission by one of the parties.
Quantum Quorum Media N.V.
Quantum Quorum Media N.V. is the exclusive distributor of Amigoe Aruba's digital news content. It handles the digital distribution of news and information through Amigoe Aruba's online platforms. Quantum Quorum Media N.V. enters into agreements with subscribers who want access to these digital editions and with advertisers who wish to use the platforms. It is registered with the Chamber of Commerce and Industry in Aruba under number H56956.0
General Terms of Delivery
The Terms and Conditions contained herein and applicable to all subscription agreements between the Subscriber and Quantum Quorum Media N.V.
Article 2: Applicability
The General Terms of Delivery apply to all subscription agreements between the Subscriber and Quantum Quorum Media N.V.. With the conclusion of the subscription, the Subscriber declares to agree with these terms and conditions.
The provisions of these General Supply Terms and Conditions may only be deviated from in writing. In that case, in addition to the agreed deviation(s), the other provisions of these General Terms of Delivery shall remain in full force.
These General Delivery Terms and Conditions are filed with the Chamber of Commerce and Industry in Willemstad, Aruba, for inspection and can be sent upon request. When entering into a subscription agreement, a copy of the delivery conditions will be attached thereto.
Article 3: Agreements.
3.1 The subscription agreement can be either written or electronic.
3.2 Quantum Quorum Media N.V. is entitled to refuse a request to enter into a subscription agreement without giving reasons.
Article 4: Access to digital editions
4.1 Quantum Quorum Media N.V. will provide access to the digital editions of Amigoe Aruba from the date agreed upon in the subscription agreement.
4.2 Access to the digital editions is personal and is granted to one individual user per subscription. The user has unlimited access to all available digital editions of Amigoe Aruba for the duration of the subscription.
4.3 It is expressly prohibited to share login credentials or to be used by multiple individuals at the same time. If abuse or account sharing is detected, Quantum Quorum Media N.V. reserves the right to immediately suspend or terminate access without refund of paid subscription fees.
4.4 The Subscriber is responsible for keeping the personal login details confidential and preventing unauthorized use. Quantum Quorum Media N.V. is not liable for any damage or loss resulting from unauthorized use.
4.5 Complaints about access to the digital editions should be reported as soon as possible to Quantum Quorum Media N.V. via customer service. Quantum Quorum Media N.V. will do everything possible to restore access.
Article 5: Payment
5.1 The subscription fee must be paid in advance via the payment methods indicated. The subscription fee can be paid monthly, quarterly, semi-annually or annually.
5.2 Quantum Quorum Media N.V. reserves the right to change subscription rates. These changes will be announced in a timely manner through the digital editions of Amigoe Aruba.
5.3 Failure to pay the subscription fee on time may result in suspension of access to the digital editions until all outstanding amounts are paid in full.
Article 6: Change of address
6.1 The Subscriber must communicate changes in e-mail address or contact information to Quantum Quorum Media N.V. in a timely manner to ensure uninterrupted access to the digital editions.
Article 7: Temporary discontinuation of subscription
The Subscriber may request a temporary discontinuation of the subscription in the event of a temporary absence. Such request must be made in writing. Any administration fees may be charged.
Article 8: Termination of subscription.
8.1 Subscriptions can only be terminated by written notice with two weeks' notice before the start of the new payment period.
8.2 Quantum Quorum Media N.V., upon receipt of the notice of termination, will confirm in writing that the subscription is terminated, indicating the final termination date.
Article 9: Copyrights
9.1 The contents of the digital editions of Amigoe Aruba may not be reproduced, stored or made public in any manner whatsoever without the prior written consent of Quantum Quorum Media N.V.
9.2 All copyright and database rights related to the content of Amigoe Aruba remain the exclusive property of Quantum Quorum Media N.V..
Article 10: Liability
Quantum Quorum Media N.V. is not liable for the content of the digital editions of Amigoe Aruba, nor for damages resulting from technical failures or temporary interruptions of access.
Article 11: Changes
Quantum Quorum Media N.V. reserves the right to modify these General Terms and Conditions at any time. Changes will be communicated to Subscribers in a timely manner through the digital editions of Amigoe Aruba.
Article 12: Disputes and applicable law
12.1 Disputes arising from these General Conditions shall be submitted to the competent court in Willemstad, Curaçao.
12.2 These General Conditions are exclusively governed by the laws of the Netherlands Antilles.
