Er is <strong>geen registratie<\/strong> bij een bureau voor intellectuele eigendom nodig om beschermd te zijn.<\/p>\n\n\n\n<p>Registratie kan later nuttig zijn als <strong>bewijs<\/strong>, maar het is <strong>geen voorwaarde<\/strong> om rechten te hebben of af te dwingen.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Publieke uitvoering en viraliteit veranderen niets<\/strong><\/h4>\n\n\n\n<p>Het feit dat een nummer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>publiekelijk is gepresenteerd,<\/li>\n\n\n\n<li>is gedeeld op sociale media,<\/li>\n\n\n\n<li>viraal is gegaan,<\/li>\n\n\n\n<li>onderdeel is van een wedstrijd of event,<\/li>\n<\/ul>\n\n\n\n<p>doet <strong>niets af<\/strong> aan de rechten van de maker. Integendeel: publieke bekendheid bevestigt vaak juist <strong>auteurschap en datum van creatie<\/strong>, wat juridisch in het voordeel van de artiest werkt.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Wat mag niet zonder toestemming?<\/strong><\/h4>\n\n\n\n<p>Zonder expliciete toestemming van de maker of diens vertegenwoordiger is het <strong>niet toegestaan<\/strong> om:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>T-shirts, caps of andere merchandise te verkopen met verwijzingen naar het nummer, de lyrics of de buzz eromheen;<\/li>\n\n\n\n<li>het nummer commercieel te gebruiken (reclames, events, content met monetisatie);<\/li>\n\n\n\n<li>te profiteren van de naam, tekst of herkenbare elementen van het werk.<\/li>\n<\/ul>\n\n\n\n<p>Wie dat toch doet, pleegt <strong>auteursrechtinbreuk<\/strong> en kan:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>aansprakelijk worden gesteld,<\/li>\n\n\n\n<li>verplicht worden winst af te dragen,<\/li>\n\n\n\n<li>geconfronteerd worden met een verbod of schadeclaim.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Kan de artiest geld vragen of procederen?<\/strong><\/h4>\n\n\n\n<p>Ja. Volledig en ondubbelzinnig.<br>De maker heeft het exclusieve recht om:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>gebruik toe te staan of te verbieden;<\/li>\n\n\n\n<li>licenties te verlenen;<\/li>\n\n\n\n<li>een vergoeding te eisen;<\/li>\n\n\n\n<li>juridische stappen te zetten bij misbruik.<\/li>\n<\/ul>\n\n\n\n<p>Dat geldt <strong>ook als het werk nooit is geregistreerd<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Moreel \u00e9n juridisch: respect de maker<\/strong><\/h4>\n\n\n\n<p>Los van de wet is er ook een duidelijke morele grens.<\/p>\n\n\n\n<p><em>Aan iedereen die op de hype springt van Lord Lally\u2019s Soca-moment:<br><strong>eet geen brood van de naam van een artiest zonder hem te laten mee-eten.<\/strong><\/em><\/p>\n\n\n\n<p><em>Print je shirts, maak je caps, ride the wave, maar <strong>cut the man in<\/strong>.<\/em><\/p>\n\n\n\n<p><em>Geen applaus met \u00e9\u00e9n hand en ondertussen hustlen met de andere.<br>Echte support is respect.
