ORANJESTAD<\/strong> \u2014 De rechter heeft vorige week uitspraak gedaan in een zaak die was aangespannen door vijftien leden van raden van commissarissen en toezicht van WEB, Elmar, AWSS en ARE. Zij stapten naar de rechter nadat zij na de regeringswisseling door het kabinet waren ontheven uit hun functie.<\/p>\n

Volgens het vonnis is aannemelijk dat de regering-AVP\/Futuro de betrokken bestuurders om politieke redenen heeft ontslagen. De rechter oordeelde dat de stelling van de commissarissen, dat het besluit uitsluitend was gebaseerd op \u2018partijpolitieke redenen\u2019, aannemelijk is.<\/p>\n

In de uitspraak staat onder meer dat \u2018de enkele wijziging van de politieke samenstelling van de regering van Aruba geen automatische grond oplevert om zittende bestuursleden dan wel leden van een Raad van Toezicht, die onder een andere politieke signatuur zijn aangesteld, te ontslaan\u2019.<\/p>\n

Met andere woorden: het enkele feit dat deze personen onder een vorig kabinet zijn benoemd, vormt op zichzelf geen rechtsgeldige reden voor ontslag. De rechter stelde verder vast dat de ontslagbesluiten onvoldoende waren gemotiveerd.<\/p>\n

Daarom moeten de vijftien betrokkenen voorlopig in hun functie worden hersteld. Ook hebben zij recht op doorbetaling totdat de zaak inhoudelijk is behandeld in een bodemprocedure.<\/p>\n

MEP-fractieleider Evelyn Wever-Croes reageerde in een verklaring kritisch op het kabinet. Zij stelt dat deze uitspraak volgens haar past in een reeks vonnissen die nog tegen de regering-AVP\/Futuro zouden kunnen volgen. Wever-Croes spreekt van voortdurende politieke vervolging van personen van wie wordt vermoed dat zij een andere politieke voorkeur hebben.<\/p>\n

Zij noemde daarbij met name minister Arthur Dowers en minister Gerlien Croes. Over laatstgenoemde zei Wever-Croes het betreurenswaardig te vinden dat een bewindspersoon die volgens haar een nieuwe politieke stijl had toegezegd, zich nu juist schuldig zou maken aan politieke vervolging.<\/p>\n","protected":false},"excerpt":{"rendered":"
